Beerwin's World of Stuff Software License

1. Introduction

This license applies to any software released by Beerwin's World of Stuff, except to those marked "open source". To "open source" software, the GPL is applied instead. This license states conditions about use and distribution, of BWS software.
The term "Software" means any software released by Beerwin's World of Stuff.
The term "Publisher" means Beerwin's World of Stuff

2. Granted Rights

Beerwin's World of Stuff, grants hereby, uncoditional use of the Software, by any person or entity, for any purpose, being home or commercial. Redistribution rights are granted, with the following conditions:

  • Conditions for redistribution over the web

    • Distribution of the entire package, as it was downloaded from Beerwin's World of Stuff
    • Express mention with hyperlink to Beerwin's World of Stuff
    • Free Uncapped download from Beerwin's World of Stuff and/or Distribution Website
    • No access fees or registration: Beerwin's World of Stuff does not tolerate Distributors which require registration (being free or not) for download (excepted other site services, such as rating, commenting, etc.). This License withdraws distribution rights from Distributors that break this rule.
    • Distribution over warez sites, sexual content sites, with keygens, cracks (related to any non-BWS commercial/free software) is strictly prohibited

  • Conditions for redistribution on any kind of media

    • Distribution of the entire package, as it was downloaded from Beerwin's World of Stuff
    • Express mention to Beerwin's World of Stuff (or at least to it's website(http://www.beerwin.com))
    • Media expenses may apply only if any. Expensive "freeware and shareware collections" are not allowed. We do not tolerate freeware selling.

  • Conditions for redistribution through peer-to-peer file sharing

    • Distribution of the entire package, as it was downloaded from Beerwin's World of Stuff
    • The Software cannot be packaged together with wareze, serials, cracks, etc.
    • The software cannot be packaged together with other similar software
    • The package must not be encrypted, or locked with passkey

3. Restrictions

The Software, being closed-source, the following actions are prohibited: decompiling, reverse engineering, disassembly, cracking, partial or integral modifications.
Data or code extraction is also prohibited, except the following: Tag lists, Code Snippets(for redistribution and sharing) and configuration files

4. Disclaimer of Warranty.

THERE IS NO WARRANTY FOR THE SOFTWARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED BEERWIN'S WORLD OF STUFF PROVIDES THE PROGRAM “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

5. Limitation of Liability.

IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MODIFIES AND/OR CONVEYS THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Interpretation of Sections 4 and 5.

If the disclaimer of warranty and limitation of liability provided above cannot be given local legal effect according to their terms, reviewing courts shall apply local law that most closely approximates an absolute waiver of all civil liability in connection with the Program, unless a warranty or assumption of liability accompanies a copy of the Program in return for a fee.
